These Terms of Service ("Terms") govern your access to and use of the bluEmber website and the request, purchase, or use of any bluEmber lighting products and installation services (collectively, the "Services"). By using the site or engaging our Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to submit a form or purchase Services. If you're acting for a company, you represent that you're authorized to bind it.

2. Quotes, estimates, and orders

Quotes are estimates based on the information you provide and standard site conditions. Final pricing may change after an on-site assessment. Orders are accepted when we confirm scope and deposit in writing.

3. Installation and access

You are responsible for granting safe access to the property, disclosing known hazards, and identifying underground utilities before installation. bluEmber and its authorized dealers install to industry-standard practices.

4. Warranty

bluEmber lighting systems are covered by a limited manufacturer warranty on the LED track and controller. Installation workmanship is warranted by the installing dealer per its own service terms. Warranty details are provided at the time of purchase and exclude damage from misuse, alteration, unauthorized service, weather events outside product ratings, and normal wear.

5. Acceptable use of the website

• Don't submit false, misleading, or third-party personal information without permission.
• Don't attempt to breach security, reverse-engineer, or interfere with the site.
• Don't scrape or reuse our content, imagery, or brand assets without written consent.

6. Intellectual property

The bluEmber name, logo, product designs, photography, and site content are owned by bluEmber or its licensors and protected by law. Limited use is granted only for personal, non-commercial browsing.

7. Third-party links and dealers

The site may link to third-party sites and to authorized dealer pages. We are not responsible for the content, offers, or practices of any third party.

8. Disclaimers

The site and its content are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, bluEmber will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the site or Services. Our aggregate liability for any claim related to the Services will not exceed the amount you paid us for the Services giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless bluEmber, its dealers, and its personnel from any claim arising out of your breach of these Terms or misuse of the Services.

11. Governing law and disputes

These Terms are governed by the laws of the State of Montana, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Montana, and you consent to their jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. Continued use of the site after changes are posted means you accept the updated Terms.
